Winchester Lesbian Couple Files Suit Challenging Va.'s Gay Marriage Ban
WINCHESTER — A Winchester lesbian couple today filed a lawsuit against Gov. Bob McDonnell challenging the state’s gay marriage ban.
Victoria Kidd and Christy Berghoff, who married in Washington D.C., joined Joanne Harris and Jessica Duff, a couple from Staunton, in filing the lawsuit in U.S. District Court in Harrisonburg.
Also listed as defendants are Janet M. Rainey, state registrar of vital records, and Staunton Circuit Court Clerk Thomas E. Roberts.
The women are being represented by lawyers with the American Civil Liberties Union and the Lamda Legal Defense and Education Fund.
The complaint states banning same sex marriage violates the plaintiffs’ constitutional rights and is discriminatory.
It asks the court to require Virginia to issue marriage licenses to gays, and to recognize the validity of homosexual marriages.
