A Clarke County Circuit Court judge has ruled that the 30-foot-tall earth berm, rising behind the home of Peter and Melissa Dunning, is not a violation of the special-use permit issued to Stuart Perry Quarry in 1995, when it added an asphalt plant to the operation. The Dunnings’ daughter posed for this picture to show the size of the berm, located just 25 feet from their property line.
