3 charged for possession of contraband cigarettes

WINCHESTER — Three Winchester residents remain jailed after they were found with 26 cartons of cigarettes and one admitted that he resells them.
Guane Rong Chen, 36, Yu Ting Gua, 25, and Xue Wen Guan, 53, all of Winchester, are each charged with one count of possession of contraband cigarettes with intent to distribute.
Each was granted a secured bond Wednesday in Frederick County General District Court, but all three are being held at the Northwestern Regional Adult Detention Center on U.S. Immigrations and Customs Enforcement detainers.
According to court documents, Frederick County Sheriff’s Office deputies were called Tuesday to the Sheetz at 1574 Martinsburg Pike for reports of subjects buying a large number of cigarettes.
Before officers arrived, the trio left the scene — but were later found in their vehicle with the cigarettes.
According to court documents, Guan admitted that he resells them.
Chen, Gua and Guan are scheduled to appear separately in Frederick County General District Court at 1:30 p.m. on Feb. 12.
The charges against the trio are Class 2 misdemeanors, punishable by up to six months in jail and or a fine of up to $1,000.
The taxes on cigarettes are about 30 cents per pack in Virginia compared to $4.25 in New York, where many of them are resold for profit.
